Moduly dálkového přístupu jsou společným projektem společnosti Gira a její dceřiné společnosti ise Individuelle Software und Elektronik GmbH. K používání modulů dálkového přístupu jsou zapotřebí software a portálový server ise Individuelle Software und Elektronik GmbH. Pro ně platí níže uvedené podmínky používání. These terms of use (“contract”) are understood to be the contract between you and ise Individuelle Software und Elektronik GmbH (hereafter referred to as “securedeviceaccess.net”, “Secure Device Access”, “we”, “our” and “us”). This contract governs both your and our rights and duties regarding the use of the Secure Device Access portal server.
In addition to the contract at hand there is usually another contract effective between you and the manufacturer of the SDA Connector you use. This second contract may contain promises which extend the rights granted to you by the contract at hand. In the case of “ise smart connect KNX Remote Access” used as SDA Connector the manufacturer is ise Individuelle Software und Elektronik GmbH, Oldenburg. As Secure Device Access we provide our services on behalf of the respective manufacturer. Secure Device Access is not liable for warranted characteristics granted to you by the manufacturer.
In the course of the continual development of our services, we occasionally incorporate additional functions and features. This means that the contract and guidelines must be modified to take these adjustments into account. For this reason, modifications to this contract and these guidelines may be made at any time and then published on our website Secure Device Access, thus taking legal effect. Except for the case described below, all modified conditions take effect 30 days after their initial publication on our website.
1. Entitlement
Our service is available only to individual persons or companies permitted to conclude legally binding contracts based on valid legislation. For this reason our service is not available to people under 18 years old. We reserve the right to cease provision of our service, change requirements for your use of the service and/or to terminate this contract with you at any time by informing you via e-mail. Termination of the contract will take immediate effect if the reason is important. Otherwise, the termination period is 60 months from the day of notification.
It lies within your responsibility to be able to receive this notification provided that we send it to the e-mail address stored in our database and associated with your account. By the act of sending the notification it is presumed as being delivered.
2. Services
The services provided include access to the user interface of the Secure Device Access and – to the extent technically possible – the access via internet to the SDA connectors associated with your user account or approved for your access by other means.
Additional separate conditions may apply to individual areas of the Secure Device Access portal or for special forms of accessing an SDA connector. When registering for these areas, or at the first access, users are expressly notified of the conditions applicable for these areas. Those specialised conditions then precede these conditions for use of such services.
We reserve the right to recall parts of our online services and the agreed-upon modules at any time if we are not or no longer authorised to grant user rights pursuant to this contract and if we are not expected to acquire the rights for further use.
3. Enforcement and delivery channel
Our service is provided via the Internet transport medium. The communication protocols used here is HTTPS (HTTP encrypted via TLS).
4. Warranty
We are committed to doing everything possible to ensure the accuracy and reliability of our online services. We will not be held liable by you or third parties in case of errors, interruptions, delays, incorrect data or messages or other malfunctions or their cause(s). We will only be liable for wilful and grossly negligent causes of damage, irrespective of the legal and contractual grounds.
5. Data protection
The protection of your private sphere and, accordingly, your personal data while using our online services is of utmost importance to us. For this reason, we have explained our methods of handling your personal data in our declaration of data protection.
6. Other provisions
6.1. These terms of use and the relationship of the user to us are subject to German law only.
6.2. Should one or more of these terms of use be or become ineffectual, the validity of the remaining conditions will not be affected.
6.3. We reserve the right to modify these terms of use for the future at any time.
